By accessing this website and making a booking with VIVA India, you agree to be bound by the following Terms and Conditions. Please read them carefully before confirming your reservation or making any payment.
1. PASSPORTS & VISAS
- A valid visa is mandatory to travel to India for all foreign nationals.
- Travelers must hold a passport valid for at least six (6) months from the date of arrival in India.
- Obtaining a passport and visa is the sole responsibility of the traveler.
- VIVA India is not responsible for visa refusals, delays, or any issues related to travel documents.
- Passport and visa processing fees are not included in the tour cost.
2. BOOKINGS & PAYMENTS
- To confirm a booking, an advance payment per person is required.
- Payments can be made via:
- Credit or Debit Cards
- PayPal
- Bank Transfer
- All online payments are processed through secure payment gateways.
Upon receipt of the advance payment, a booking and payment confirmation will be sent via email.
3. BALANCE PAYMENT
- The remaining balance can be paid:
- Before arrival via bank transfer, or
- Upon arrival in India using a credit or debit card
- For certain services such as luxury trains, luxury hotels, or peak season travel (Christmas, New Year, etc.), full payment in advance may be required.
4. PAYMENT GATEWAY & TRANSACTION FEES
- Payments made via PayPal or credit/debit cards may be subject to a processing fee of up to 4%.
5. GOVERNMENT TAXES & SURCHARGES
Any increase in:
- Government taxes
- Monument or museum entrance fees
- Fuel prices
- Guide or transportation charges
will be charged as an additional cost, even after tour confirmation.
6. DOMESTIC & INTERNATIONAL AIR TICKETS
- Airline tickets are subject to the terms and cancellation policies of the respective airlines.
- VIVA India is not responsible for:
- Flight delays or cancellations
- Weather conditions
- Airline operational issues
- Assistance will be provided where possible, but no financial liability is accepted.
7. AMENDMENTS TO BOOKINGS
- Changes to confirmed bookings are not encouraged.
- If changes are requested, we will make every effort to accommodate them, subject to availability and additional costs.
8. USE OF VEHICLES
- Vehicle costs include transportation strictly as per the confirmed itinerary.
- Any additional use of the vehicle beyond the itinerary is not included unless specifically mentioned.
9. CANCELLATION & REFUND POLICY
All cancellations must be submitted in writing via email. The effective date of cancellation will be the date the email is received by VIVA India.
Cancellation Charges:
From the date of the reservation payment, that is, the initial deposit, a 100% refund is available within the first 72 hours, after that, no refund will be issued for that amount.
- More than 180 days before arrival: 80% refund
- 90–180 days before arrival: 40% of tour cost charged
- 45–90 days before arrival: 70% of tour cost charged
- Less than 45 days before arrival or No-Show: No refund
Note:
Bank charges, transaction fees, and payment gateway fees will be deducted from the refundable amount.
10. LIABILITY & RESPONSIBILITY
VIVA India is responsible only for services directly under its control.
The company shall not be liable for:
- Personal injury, illness, accident, or death
- Loss, theft, or damage to personal belongings
- Delays, additional expenses, or inconvenience
- Events beyond our control, including but not limited to:
- Natural disasters
- Strikes or labor disputes
- Civil unrest or war
- Terrorist activities
- Extreme weather conditions
- Airport or port closures
11. TRAVEL INSURANCE
- VIVA India does not provide travel insurance.
- Travelers are strongly advised to purchase comprehensive travel insurance covering:
- Medical emergencies
- Accidents
- Theft or loss
- Trip cancellation or interruption
All baggage and personal belongings remain at the traveler’s own risk.
12. HOTEL CHECK-IN & CHECK-OUT POLICY
- Standard hotel timings are:
- Check-in: 12:00 – 14:00 hrs
- Check-out: 10:00 – 12:00 hrs
- Early check-in and late check-out are subject to availability and not included in the tour cost.
- If the listed hotel is unavailable, an alternative hotel of similar category will be provided.
13. COMPLAINTS & GRIEVANCES
- Any complaints during the tour must be reported immediately to the VIVA India tour manager or representative.
- We will make every reasonable effort to resolve issues promptly.
- 24-hour assistance is available during the tour.
14. GOVERNING LAW
These Terms and Conditions are governed by the laws of India, and any disputes shall be subject to the jurisdiction of Indian courts.
